Terms of Service

These Terms of Service (“Terms”) govern your use of the downtime mobile application (“the app”, “we”, “our”). By creating an account or using the app, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use downtime. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian’s consent.
2. Account
- You sign in using Sign in with Apple. You are responsible for maintaining the security of your Apple ID.
- You are responsible for all activity that occurs under your account.
- You may only maintain one account.
3. Your Content
“Your Content” includes sleep posts, comments, reactions, profile photos, and display names that you create or upload.
- You retain ownership of Your Content.
- By posting content, you grant downtime a non-exclusive, royalty-free license to display Your Content to your accepted friends within the app as part of the service’s functionality.
- You are solely responsible for Your Content and represent that it does not violate any third-party rights.
4. Acceptable Use
You agree not to:
- Harass, bully, threaten, or intimidate other users
- Post content that is abusive, hateful, obscene, or discriminatory
- Impersonate another person or create fake accounts
- Attempt to access another user’s account or data
- Interfere with or disrupt the app’s infrastructure
- Use the app for any illegal purpose
- Scrape, crawl, or use automated tools to access the service
- Attempt to reverse-engineer the app
We reserve the right to suspend or terminate accounts that violate these terms.
5. Health Data Disclaimer
- downtime provides a sleep score for informational and entertainment purposes only.
- The sleep score is not medical advice, diagnosis, or treatment.
- Do not rely on downtime’s sleep score for medical decisions. Consult a healthcare professional for sleep-related health concerns.
- We make no guarantees about the accuracy of data sourced from Apple HealthKit or WHOOP.
6. WHOOP Integration
- Connecting your WHOOP account is optional.
- By connecting WHOOP, you authorize downtime to access your WHOOP sleep data through WHOOP’s official API.
- You may disconnect your WHOOP account at any time through the app’s settings. Disconnecting immediately revokes our access and deletes your stored WHOOP tokens.
7. Intellectual Property
- The downtime app, including its design, code, and branding, is our intellectual property.
- You may not copy, modify, distribute, or create derivative works based on the app.
8. Availability
- We strive to keep the app available but do not guarantee uninterrupted service.
- We may modify, suspend, or discontinue the app at any time with or without notice.
- We are not liable for any loss resulting from service interruptions.
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.
11. Termination
- You may delete your account at any time by contacting us.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your right to use the app ceases immediately. We will delete your data in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the app after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
